Abstract concepts used

"Personal data" means any and all information relating to any identified or identifiable individual (hereinafter referred to as a "person concerned"). Here, an individual is considered to be identifiable if he or she can be identified directly or indirectly, specifically through association with an identifier such as a name, an identification number, location or tracking data, online identification data (such as a cookie) or with one or several distinctive feature or features that is or are an expression of the physical, physiological, genetic, economic, cultural or social identity of that individual.

"Processing" means any process whether or not facilitated through automated procedures and any such series of processes in connection with personal data. This term is extensive and practically covers any handling of data.

The term "data controller" designates any and all individuals or legal entities, authorities, institutions or agencies that, alone or together with others, decide on the purposes and means of the processing of personal data.

Relevant legal bases

In accordance with Section 13 of GDPR, we hereby advise you of the legal bases of our data processing activities. The following applies if and where the legal basis is not mentioned in the privacy notice: The legal basis for obtaining consents is Section 6(1)(a) and Section 7 of GDPR; the legal basis for processing activities for the provision of our services and for the performance of contractual arrangements or for responding to inquiries is Section 6(1)(b) of GDPR; the legal basis for processing activities for the fulfillment of our legal obligations or requirements is Section 6(1)(c) of GDPR; and the legal basis for processing activities for the protection of our legitimate interests is Section 6(1)(f) of GDPR respectively. In case vital interests of the person concerned or of any other individual should necessitate the processing of personal data, Section 6(1)(d) of GDPR will serve as the legal basis.

Safety precautions and security measures

Please obtain information regarding the content of our privacy notice and policy at regular intervals. We will revise our privacy notice and policy whenever any changes in the data processing activities carried out by us will so require. We will advise you whenever said changes require cooperation or assistance on your end (such as the granting of consent) or whenever some other personal advice note will have to be given respectively.

Cooperation with data processors or third parties

If, within the scope and limits of our data processing activities, we disclose any data to others, individuals or entities (data processors or third parties), we transmit data to the same or grant them access to said data, this will exclusively occur based on a legal permission (that is where data transmission to third parties such as payment service providers is required for the performance of a contract in accordance with Section 6(1)(b) of GDPR), subject to your consent, if this is required by legal requirements or based on our legitimate interests (such as where authorized representatives, webhosters or similar are used).

If and to the extent we entrust any third parties with the processing of data based on what is called a "data processing contract", this will occur based on Section 28 of GDPR.

Transmission to third countries

If and to the extent we process any data in a third country (i.e. outside the European Union (EU) or of the European Economic Area (EEA)) or if we do this through recourse to third-party services or the transmission of data to third parties, this will only occur with a view to fulfilling our contractual or pre-contractual obligations, based on your consent or based on our legitimate interests respectively. Subject to legal or contractual permission, we will process data or have data processed in a third-party country exclusively if the special requirements in accordance with Section 44 and following of GDPR are given. That is to say, said processing occurs based on special guarantees only, such as the official validation of an EU-conforming data protection level (such as through "Privacy Shield" for the US, for example) or the observation of officially recognized special contractual obligations (what is known as "standard contractual clauses").

Rights of persons concerned

You may request confirmation as to whether relevant data are being processed and you may request information regarding said data and other information and you are entitled to a copy of said data in accordance with Section 15 of GDPR. In accordance with Section 16 of GDPR, you are entitled to request that any data relating to you be completed or that any data that are not correct be corrected accordingly. In accordance with Section 17 of GDPR, you may request that relevant data be deleted with immediate effect, or alternatively, in accordance with Section 18 of GDPR, that the processing of said data be restricted. You may request that any data relating to you and that you have provided to us in accordance with Section 20 of GDPR be duly maintained or that they be transmitted to other data controllers. Moreover, in accordance with Section 77 of GDPR, you may file a complaint with the competent regulatory agency.

Right of revocation

You may revoke your consents in accordance with Section 7(3) of GDPR with effect for the future.

Right of objection

You may object to the future processing of the data relating to you in accordance with Section 21 of GDPR at any time. More specifically, you may object to any processing for purposes of direct advertising or Mailing.

Cookies and right of objection for direct advertising or mailing

"Cookies" are small data files that are stored on the computers of users. Various information may be saved within these cookies. Here, a cookie is primarily used to save the information regarding a user (or the hardware on which the cookie is stored) during or after his or her visit to a website. Cookies that will be deleted once a user exits a website and his or her browser are called temporary cookies or "session cookies" or "transient cookies" respectively. Among others, the content of a shopping cart in a web store or the log-in status may be stored in such a cookie. Cookies that remain stored even after the browser is exited are called "permanent" or "persistent". Thus, the log-in status can be saved in case the user should return to the web store after several days. Similarly such a cookie may hold the user's interests that are used for reach measurement or marketing purposes. Cookies offered by other providers than the data controller that operates the website are called "third-party cookies (otherwise, if exclusively offered by the controller, they are called "first-party cookies").

We may use temporary or permanent cookies, which we will advise in our privacy notice and policy.

Users that do not wish cookies to be stored on their computer are requested to disable the respective setting in the system settings of their browser. Cookies stored can be deleted in the system settings of the browser. Disabling cookies may result in some functional limitation of that website.

For a number of services, a general objection against the use of cookies for purposes of online marketing, more specifically in the case of tracking, may be raised through the US website http://www.aboutads.info/choices/ or the EU website http://www.youronlinechoices.com/ respectively. In addition, the storing of cookies may be avoided by disabling them in the browser settings. Please note that, in such an instance, not all the features or functions of a website may be available for use.

Deleting data

The data processed by us are deleted or their processing is restricted respectively in accordance with Section 17 or Section 18 of GDPR. Unless expressly stated otherwise in this privacy notice and policy, any data stored by us will be deleted once they will not be required anymore for their intended purpose and if such deletion is not opposed to any legal obligation to retain data. Where said data are not deleted because they are required for other purposes permitted by law, their processing will be restricted accordingly. That is to say, said data will be disabled and will not be processed for any other purposes. Among others, this applies to data that must be retained for reasons relating to commercial law or tax law respectively.

More specifically, according to statutory provisions, in Germany, the retention period is six (6) years in accordance with Section 257(1) of the German Commercial Code (HGB) (for books of account, inventories, opening balance sheets, annual financial statements, business letters, accounting records or similar) or ten (10) years in accordance with Section 147(1) of the German General Tax Code (AO) (for books, records, management reports, accounting vouchers, business or commercial letters, documents relevant to taxation or similar).

Making contact

When you make contact with us (such as by using the contact form, via electronic mail, telephone or social media), your data will be processed for the purpose of handling the contact request or for processing the same in accordance with Section 6(1)(b) of GDPR respectively.

We will delete all inquiries as soon as these will not be required any more. We will check whether they are required at intervals of two (2) years each; in addition, statutory archiving obligations will apply accordingly.
